THE WGT PEOPLE VS. THE PROS OPEN 2009 OFFICIAL RULES

NO PURCHASE OR PAYMENT NECESSARY. VOID WHERE PROHIBITED.

The WGT People vs. Pros Open consists of four (4) monthly contests, one each for the months of June, July, August, and September, 2009 (collectively, the “Contest”).  Each month’s competition includes four Tiers of competition: Hack, Amateur, Pro, and Master.  In addition to the other prizes available in this Contest, the winners of the Pro and Master tiers of the Contest will be eligible to enter and play and will receive a trip to the 2009 People vs. the Pros tournament to be held October 23rd – 27th, 2009 at the Pinehurst Resort, Pinehurst, NC (the “PVP Event”).  The PVP Event is sponsored by Innovative Media Solutions, LLC., and is governed by the PVP Official Rules located at http://pvpgolf.com/OfficialRules.aspx (the “PVP Official Rules”). All participation and play in the WGT People vs. Pros Open is governed by these Official Rules. All participation and play in the PVP Event is governed by the PVP Official Rules.  WGT may offer prize trips to and eligibility for the PVP Event (a “PVP Prize”) as prizes in other WGT contests and sweepstakes in 2009, however, there is a limit of only one (1) PVP Prize during the 2009 calendar year per person, per email address, and per WGT user account.  For more information about the PVP Event, visit the PVP Event website at  http://pvpgolf.com/TheEvent.aspx.  Current professional golfers (or those that have ever been a professional golfer), and employees of Innovative Media Solutions, Winnercomm, Pinehurst Resort, other PVP Event sponsors and member companies, affiliates, subsidiaries, direct sub-contractors, advertising agencies, printers of each of these entities and members of their immediate families are not eligible to participate in the PVP Event.
  1. Sponsor/Promoter.

    This Contest is sponsored by World Golf Tour, Inc., 180 Sansome Street, 5th Floor, and San Francisco, CA 94104.

  2. Eligibility.

    Open to individuals who are legal residents of and physically located in the fifty United States and the District of Columbia, Canada (excluding Quebec) who are 18 years of age or older or the age of majority in the entrant's state or province/territory ("province") of residence, whichever is greater. Employees, officers, and directors of World Golf Tour, Inc. ("Sponsor"), and its affiliated entities, parent, subsidiaries, advertising, promotional agencies, legal advisors, their immediate family members and persons living in their same household, are not eligible to enter or win prizes. Void where restricted, taxed or prohibited by law.

  3. How To Enter.

    To enter the Contest you must do the following:

    a.Step One. Have a valid registered World Golf Tour account (free); and

    b.Step Two. Register for the Contest. There are two ways to register for this Contest.

  1. Obtain and Apply Credits to Register for the Contest. One Thousand (1000) WGT credits will be deducted from your World Golf Tour account. If you do not have at least One Thousand credits in your World Golf Tour account you will not be eligible to register for or enter the Contest by applying WGT Credits. To obtain Credits:

    1. Obtain credits through gameplay on the World Golf Tour site; or

    2. Purchase credits on the World Golf Tour site by credit card or other financial instrument

  2. Free Method of Registration. Send a 3"x5" card with the following information hand-written on it: your name, address, World Golf Tour user name, email address, date of birth, contest name, and date, to: World Golf Tour, Inc., (include month, for example, “June”) People vs. The Pros Open Entry Request, 180 Sansome Street, 5th Floor, San Francisco, CA 94104. Within forty eight hours of Sponsor’s receipt of your postcard, Sponsor will activate your registration status in the Contest and email you confirmation of your registration status in an email sent to the email address specified in your WGT user account. You will then be able to begin to play the Game and enter the Contest. All postcards must be received at least 5 days prior to the end of the applicable Contest Period (defined below) in order for registration status to be activated during such Contest Period. Each mail-in registration request must be mailed separately, limit one mail-in request per person, per email address, and per WGT user account per Contest Period. Mail-in requests must be hand-written. Computer generated, typewritten, and other electronically or mechanically reproduced mail-in requests are not acceptable. Mail-in requests that do not conform with the requirements herein will not be acknowledged and Sponsor will disregard such requests and will not activate registration status.

c.Step Three. To enter the WGT People vs. The Pros Open, log on to the website at www.wgt.com between 1:00 am Pacific Time (in other words, California Time) ("PT") on the first day of each applicable calendar month and 11:00 pm PT on the last day of such calendar month (each a "Contest Period"), select a "Tier" for play as designated for you by Sponsor, play and complete the Eighteen Hole Stroke Play game (each a "Game") and you will automatically be entered into the Contest (each an "entry").  You must play and complete the Game between 1:00 am PT on the first day of the applicable Contest Period and 11:00 pm PT on the last day of the Applicable Contest Period and you will automatically be entered into the Contest for that month.  You may play the game only once per Contest Period and the Final Score received by you in such Game will be recorded in the entry for the applicable Contest Period.

IMPORTANT NOTICE TO ENTRANTS: ENTRANTS ARE RESPONSIBLE FOR DETERMINING THE ENTRY PERIOD TIMES IN THEIR RESPECTIVE TIME ZONES.

There will be four Contest Periods as follows: June (June 1, 2009 – June 30, 2009), July (July 1, 2009 – July 31, 2009), August (August 1, 2009 – August  31, 2009) and September (September 1, 2009 – September 30, 2009) (each a "month" or in combination with time restrictions noted above, a "Contest Period"). The last Contest Period will end on September 31, 2009 at 11:00 pm PT.

No other methods of entry will be accepted. Electronic entries must be initiated during the Contest Period and completed electronic entries must be transmitted and received by 11:00 pm PT on the last day of the applicable Contest Period.  Entries become the property of Sponsor and will not be returned. Use of multiple email addresses or multiple WGT user accounts to enter is prohibited.  To enter, the registered user of designated WGT user account must personally play the Game or the entry will be disqualified.   Use of a false email address or a false WGT user account, or an incorrect mail address will disqualify an entry. You may not allow any third party to play the Game in this Contest using your WGT user account. BY ENTERING THIS CONTEST, YOU AGREE THAT ALL SUSPECTED FRAUDULENT OR IMPROPER ENTRIES MAY BE DISQUALIFIED BY SPONSOR AT ITS SOLE DISCRETION.   Sponsor is not responsible for technical, hardware or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, lost, late, misdirected, illegible, mutilated, postage-due, garbled or delayed entries or other communications or other technical problems related to entries. Sponsor and its agents and subcontractors accept no responsibility for entries lost or delayed in submission.  Proof of submission is not proof of receipt. Sponsor, in its sole discretion, reserves the right to disqualify any person who tampers with the entry process or the operation of the website or the game, or who otherwise violates these rules. In the event of a dispute over who submitted an entry, the authorized subscriber of the e-mail account designated in the entrant's World Golf Tour user account will be deemed to be the entrant. Contest is void in Quebec, and where prohibited, restricted or taxed by law. All federal, state, provincial, and local laws and regulations apply.

  1. Game Description.

    The WGT People vs. The Pros Open is an eighteen-hole stroke play contest. There are four Tiers of competition as follows: Master, Pro, Amateur and Hack (each a "Tier"). Entrant's Tier is determined by Sponsor in its sole discretion, which may be based in whole or in part on entrant's performance and scoring in previous World Golf Tour game play on Sponsor's website, if any. An entrant may only enter into one Tier of competition per Contest Period. The entrants in each Tier will be given eighteen holes throughout the golf course, and are challenged to get the ball into the cup for each hole in the fewest strokes. The number of stokes taken to get the ball into each cup, plus any penalties, will be recorded for each entrant. When entrant completes all eighteen designated holes, the number of strokes plus penalties are totaled and comprise the entrant's final score. Entrants may play the Game only once per Contest Period. The lowest scoring entrant in each Tier per Contest Period will be a potential winner (subject to the provision below in the event of a tie between two or more entrants, and subject to meeting eligibility and all other requirements in these Official Rules).

    In the event of a tie, the better scoring entrant between or among the tied entrants will be the entrant with the lowest combined score for the final six (6) holes of the Game. If any ties remain, the better scoring entrant between or among the remaining tied entrants will be the entrant with the lowest combined score for the final three (3) holes for such Game. If any ties remain, the better scoring entrant between or among the remaining tied entrants will be the entrant with the lowest score for the 18th hole in such Game, and any remaining ties will be determined by identifying the lowest scoring entrant for each individual game hole, in sequence from 17th through to 1st, as is necessary to determine a winner and, if any ties remain at that point, the earlier-submitted entry between or among the tied entries will be deemed the better scoring entry.

  2. Prize.

    There are forty-eight (48) prizes to be awarded during the Contest, consisting of twelve (12) prizes per Contest Period as follows:

    Hack Tier:

    One (1) First Prize: Amazon.com Gift Card in the amount of Fifty Dollars (US) (one to the lowest scoring entrant, approximate retail value ("ARV") USD $50 each);

    One (1) Second Prize: Amazon.com Gift Card in the amount of Twenty-Five Dollars (US) (one to the second lowest scoring entrant, ARV USD $25 each); and

    One (1) Third Prize: Amazon.com Gift Card in the amount of Ten Dollars (US) (one to the third lowest scoring entrant, ARV USD $10 each).

    Amateur Tier:

    One (1) First Prize: Amazon.com Gift Card in the amount of  One Hundred and Twenty-Five Dollars (US)(one to the lowest scoring entrant, ARV USD $125 each);

    One (1) Second Prize: Amazon.com Gift Card in the amount of Fifty Dollars (US)(one to the second lowest scoring entrant, ARV USD $50 each); and

    One (1) Third Prize: Amazon.com Gift Card in the amount of Twenty-Five Dollars (US) (one to the third lowest scoring entrant, ARV USD $25 each).

    Pro Tier:

    One (1) First Prize PVP Event Golf Package Trip:  Roundtrip economy/coach airfare for one person from a major commercial airport near winner’s residence to Raleigh/Durham International Airport (maximum value USD $500), five nights and six days accommodations at Pinehurst resort during the PVP Event from October 22-27, 2009, including eligibility to enter and play** in the 2009 PVP Event (ARV: USD $3,995), and resort fee (ARV: USD $400) (one to the lowest scoring entrant, total ARV: USD $4,895 each);

    One (1) Second Prize: Amazon.com Gift Card in the amount of Two Hundred Dollars (US)(one to the second lowest scoring entrant, ARV USD $200 each); and

    One (1) Third Prize: Amazon.com Gift Card in the amount of One Hundred Dollars (US) (one to the third lowest scoring entrant, ARV USD $100 each).

    Master Tier:

    One (1) First Prize Trip: Roundtrip economy/coach airfare for one person from a major commercial airport near winner’s residence to Raleigh/Durham International Airport (maximum value USD $500), five nights and six days accommodations at Pinehurst resort during the PVP Event from October 22-27, 2009, including eligibility enter and play** in the 2009 PVP Event (ARV: USD $3,995), and resort fee (ARV: USD $400) (one to the lowest scoring entrant, total ARV: USD $4,895 each);

    One (1) Second Prize: Amazon.com Gift Card in the amount of Two Hundred Dollars (US)(one to the second lowest scoring entrant, ARV USD $200 each); and

    One (1) Third Prize: Amazon.com Gift Card in the amount of One Hundred Dollars (US) (one to the third lowest scoring entrant, ARV: USD $100 each).

    **Current professional golfers (or those that have ever been a professional golfer), and employees of Innovative Media Solutions, Winnercomm, Pinehurst Resort, other sponsors and member companies, affiliates, subsidiaries, direct sub-contractors, advertising agencies, printers of each of these entities and members of their immediate families are not eligible to participate in, enter, or win the PVP Event. For purposes of eligibility for the PVP Event, “immediate family” is defined as parents, spouses, siblings and children, regardless of whether they reside in the same household. If you are the winner of PVP Event Golf Package Trip, but are not eligible to participate in the PVP Event, you will forfeit the PVP Event 54-hole stroke play golf tournament component of the prize package, and the remainder of such prize will comprise your complete prize.

    Odds of winning depend on the number of eligible entrants in each Tier, their relative skill in the Contest, and the entrant's Tier designation.

    The 2009 PVP Event (October 22-27, 2009) Golf Package includes accommodations, breakfast each day, opening night reception and dinner, gala dinner with the pros on October 26th, 2009, four cocktail receptions and four rounds of golf on the following golf courses: Pinehurst No. 2, and Pinehurst 1, and 4, plus use of practice facility, range balls, green fee, and cart rental for 18 holes each day. PVP Event Golf Package winners will be invited to participate in a 54-hole stroke play golf tournament at the Pinehurst Resort from October 22-27, 2009 and, if winner qualifies during such golf tournament, in the Grand Prize PVP Event matches on October 27, 2009.  Winners must take prize trip during the October 22-27, 2009 dates or prize will be forfeited in its entirety.

    Resort Fee includes: use of the Fitness Center, on-site transportation, High Speed Internet Access in guest rooms, valet and self parking, beach club and outdoor pools (based on seasonal availability), bicycles, afternoon tea in the Carolina, practice putting greens and driving range. The Resort Service Fee also includes gratuities for staff in the dining venues covered by the meal portion of your package, as well as, the bell and door staff. Housekeeping and transportation staff do not participate in the resort services fee. Gratuities for any other service staff are at each individual’s discretion.

    Travel, accommodations, and golf course related restrictions, conditions and limitations may apply and may include, without limitation, seasonal restrictions, scheduling restrictions, and time-based restrictions (e.g., expiration dates). Travel arrangements are subject to availability. Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels, golf courses or other transportation companies or any other persons providing any of these services and accommodations necessitated by same. Sponsor shall not be liable for any loss or damage to baggage.

    Except as otherwise explicitly stated above, winner is responsible for transportation to and from any prize related events or destinations, any incidentals, including, without limitation: meals, telephone calls, facsimile charges, Internet charges, spa/beauty salon services, laundry, tours/excursions, gift shop purchases, hotel processing fees, and any other expenses not mentioned in these Official Rules, which are the sole responsibility of the winner. Any extra nights' stay and any additional costs associated with an extended stay are the sole responsibility of winner. Additional restrictions may apply. Winner must hold valid documentation for travel, and is responsible for his or her own insurance arrangements. Winners must confirm travel dates within thirty days of prize notification, but in no event later than October 7, 2009. Flight, accommodations, and golf rounds will be booked by WGT. Prize must be redeemed and used entirely between October 22, 2009 and October 27, 2009, or prize will be forfeited in its entirety. Airline tickets and accommodations must be used together and are subject to availability and certain restrictions, so Sponsor cannot guarantee prize will be available on the exact dates specified by winner. If for any reason any portion of the prize is delayed, cancelled or postponed, or becomes unavailable, Sponsor reserves the right, but is not obligated, to cancel or modify the Contest in its discretion and award a substitute prize of approximately equal or greater value.

    No substitution of prizes for cash or for other goods and services is permitted, except Sponsor reserves the right to provide a substitute prize of approximately equal or greater value if the advertised prize becomes unavailable. Prize details including, if applicable, color, style, size, and denomination at Sponsor's sole discretion. Amazon.com gift card prizes subject to standard Amazon.com gift card terms and conditions.  WGT credits subject to WGT Terms and Conditions. All taxes, including, without limitation, all federal, state, provincial, and local taxes, and international tariffs, are the sole responsibility of the winners.

    All prizes claimed in accordance with the Official Rules will be awarded. Winners may be required to provide a U.S. or Canadian shipping address to claim prize. Prizes will be mailed or otherwise disbursed within twenty-eight (28) days following Sponsor's receipt of the completed Affidavit of Eligibility and, except where and as prohibited, a Liability Release and Publicity Release, as well as verification of winner's eligibility.

  3. Winner Selection and Notification.

    Winners will be determined and announced on or about fifteen (15) days following the close of each Contest Period from all eligible entries received during the Contest Period. The judging will be conducted by Sponsor or its designee, the judge of the Contest, whose decisions are final and binding. Potential winners will be notified on or about fifteen (15) days following the close of each Contest Period by an email sent to the email address specified in the entry and posted on the World Golf Tour website. If potential winner cannot be contacted at this email, is contacted and does not respond as directed within seven (7) days of attempted notification, refuses the prize is ineligible to accept the prize or does not otherwise comply with these Official Rules, the prize may be forfeited and awarded to an alternate winner. Potential winner may be required to complete and sign an Affidavit of Eligibility and, except where and as prohibited, a Liability Release and a Publicity Release in the form provided by Sponsor, within seven (7) days of attempted notification in order to claim the prize. Potential winners may be required to show proof of identification within seven (7) days of attempted notification, or the prize may be forfeited and awarded to an alternate winner.

  4. General Terms.

    By entering the Contest, entrant accepts and agrees to abide by and be bound by the terms of these Official Rules, and assumes sole liability and accepts all risk of loss for injuries, including personal injuries and/or damage to property, caused or claimed to be caused by participating in this Contest or the acceptance, possession, shipping and handling, loss, use or misuse of, or travel to or from or in connection with the Contest or any prize awarded. Sponsor has the right to cancel, terminate or modify this Contest for any reason, including if it cannot be completed as planned due to computer virus, bugs, tampering, unauthorized intervention or technical failures and to select winner from eligible entries received on or before the termination date. Sponsor is not responsible for any failure to contact entrants, whether due to technical or human error.

    By entering this Contest, entrants grant to Sponsor a worldwide, perpetual, irrevocable, right and royalty-free license to use the entry, and, except where prohibited by law, entrant's first and/or last name, city and state/province of residence, photo(s), voice and/or likeness; in any and all media in connection with this Contest. By entering this Contest, entrants agree (a) that Sponsor has the right to exploit and utilize entrant's first and/or last name, city and state/province of residence, photo(s), voice and/or likeness in any and all media without any further attribution, notification or compensation to Entrant, except where prohibited; (b) to be bound by these Official Rules and the decisions of the judges; and (c) to be contacted by Sponsor or its agents by telephone, mail or email regarding this Contest.

    By entering the Contest, entrant releases and holds harmless Sponsor and its parent companies, subsidiaries, affiliates, and the directors, officers, employees or agents of each from any and all liability whatsoever for any claims, costs, injuries, losses or damages of any kind (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light) arising out of or in connection with the Contest, the acceptance, possession, use, or misuse of any prize, or arising out of or in connection with any travel to or from any Contest or prize related activity.

    Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys' fees; and entrant hereby waives all rights to claim punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

    In the event that any provision of these Official Rules shall be unenforceable or invalid under any applicable law or be so held by applicable court decision, such unenforceability or invalidity shall not render these Official Rules unenforceable or invalid as a whole, and, in such event, such provision shall be changed and interpreted so as to best accomplish the objectives of such unenforceable or invalid provision within the limits of applicable law or applicable court decisions.

  5. Applicable Law.

    The Contest is governed by the laws of the state of California applicable to contracts entered into by California residents and to be performed within such State without regard to its conflict of law provisions, with venue in San Francisco County, California.

  6. Winners list.

    A list of Contest winners can be viewed on the "Recent Winners" webpage at www.wgt.com, and is also available by sending a stamped and self-addressed envelope marked to “WGT People vs. The Pros Open Winners, (include month, for example, “June”), 2009," 180 Sansome Street, 5th Floor, San Francisco, CA 94104. Requests must be received by October 7, 2009.

AFFIDAVIT OF ELIGIBILITY/RELEASE OF PUBLICITY AND LIABILITY

I represent and certify to World Golf Tour, Inc. ("Sponsor"), that I was 18 years of age or older as of the date of entry (or if the age of majority in my state or province/territory is greater than 18 years of age, I was at least the age of majority in my state or province/territory of residence as of the date of entry) and I am a legal resident of one of the fifty United States, the District of Columbia, or Canada (excluding Quebec), and that I personally played the winning Game in the Contest. I hereby certify that I am eligible, under the “WGT People vs. The Pros Open" (the "Contest") official rules (the "Rules"), to claim the applicable prize set forth below and further described in the Rules (the "Prize"). I represent that I have read, fully understand, have complied with, and agree to be bound by the Rules.

I grant Sponsor a worldwide, perpetual, irrevocable, right and royalty-free license to use my entry and, except where prohibited by law, my first and/or last name, city and state/province of residence, photo(s), voice and/or likeness; in any and all media.

I release and hold harmless Sponsor and its parent companies, subsidiaries, affiliates, and the directors, officers, employees or agents of each, from any and all liability whatsoever for any claims, costs, injuries, losses or damages of any kind (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light) arising out of or in connection with the Contest, with the acceptance, possession, use, or misuse of any prize, or arising out of or in connection with any travel to or from any Contest or prize related activity.

In the event that any provision of this Affidavit Of Eligibility/Release Of Publicity And Liability shall be unenforceable or invalid under any applicable law or be so held by applicable court decision, such unenforceability or invalidity shall not render this Affidavit Of Eligibility/Release Of Publicity And Liability unenforceable or invalid as a whole, and, in such event, such provision shall be changed and interpreted so as to best accomplish the objectives of such unenforceable or invalid provision within the limits of applicable law or applicable court decisions.

This Affidavit of Eligibility/Release of Publicity and Liability is governed by the laws of the California applicable to contracts entered into by California residents and to be performed within such State without regard to its conflict of law provisions with venue in San Francisco, California.
