WGT MONTHLY CLOSEST TO THE PIN TOURNAMENT RULES

NO PURCHASE OR PAYMENT NECESSARY. VOID WHERE PROHIBITED.

  1. Eligibility.

    Open to individuals who are legal residents of and physically located in the fifty United States and the District of Columbia, Canada (excluding Quebec), the United Kingdom, and Germany, who are 18 years of age or older or the age of majority in the entrant�s state or province/territory (�province�) of residence, whichever is greater. Employees, officers, and directors of World Golf Tour, Inc. (�Sponsor�), and its affiliated entities, parent, subsidiaries, advertising, promotional agencies, legal advisors, their immediate family members and persons living in their same household, are not eligible to enter or win prizes. Void where restricted, taxed or prohibited by law.
  2. How To Enter.

    To enter the WGT Monthly Closest to the Pin Tournament (the �Contest�) you must do the following:

    Step One. Have a valid registered World Golf Tour account (free); and

    Step Two. Obtain and Apply Credits to Register for the Contest. In order to register for this Contest One Hundred (100) WGT credits will be deducted from your World Golf Tour account. If you do not have at least One Hundred credits in your World Golf Tour account you will not be eligible to enter the Contest. To obtain Credits:

    1. Obtain credits through gameplay on the World Golf Tour site;
    2. Purchase credits on the World Golf Tour site by credit card or other financial instrument; or
    3. Free Method of Entry. Send a 3�x5� card with your name, address, World Golf Tour user name, email address, date of birth, contest name, and date, to: World Golf Tour, Inc., November Closest to the Pin Tournament Credit Request, 160 Sansome Street, 5th Floor, San Francisco, CA 94104. Your World Golf Tour account will be credited with One Hundred (100) WGT credits within forty eight hours of Sponsor�s receipt of your postcard, which will enable you to apply credits from your account and register for the Contest. All postcards must be received at least 5 days prior to the end of the Contest Period (defined below) in order for the credits to be applied to the account during such Contest Period. Each mail-in request for credits must be mailed separately.

    Step Three. Log in to the website at www.wgt.com, between 1:00 am Pacific Time (in other words, California time) (�PT�) on November 1, 2008 through 11:59 pm PT November 30, 2008 (the �Contest Period�), select a �Tier� for play as designated for you by Sponsor, play and complete the Nine Hole Closest to the Pin game (the �Game�) and you will automatically be entered into the Contest (each an �entry�). One Hundred WGT credits will be deducted from your World Golf Tour account to enter this Contest. You may play the Game only once during the Contest Period and the Final Score received by you in such Game will be recorded in the entry.

    IMPORTANT NOTICE TO ENTRANTS: ENTRANTS ARE RESPONSIBLE FOR DETERMINING THE CONTEST ENTRY PERIOD TIMES IN THEIR RESPECTIVE TIME ZONES.

    No other methods of entry will be accepted. Completed electronic entries must be transmitted during the Contest Period and received by 11:59 pm PT November 30, 2008. Entries become the property of Sponsor and will not be returned. Use of multiple email addresses to enter is prohibited. Use of a false email address or account, or an incorrect mail address will disqualify an entry. Sponsor is not responsible for technical, hardware or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, lost, late, misdirected, illegible, mutilated, postage-due, garbled or delayed entries or other communications or other technical problems related to entries. Sponsor, in its sole discretion, reserves the right to disqualify any person who tampers with the entry process or the operation of the website or the game, or who otherwise violates these rules. In the event of a dispute over who submitted an entry, the authorized subscriber of the e-mail account designated in the entrant's World Golf Tour user account will be deemed to be the entrant. Contest is void in Quebec, and where prohibited, restricted or taxed by law. All federal, state, provincial, and local laws and regulations apply.

  3. Game Description.

    The WGT Monthly Closest to the Pin Tournament is a nine hole Closest to the Pin contest. There are two Tiers of competition as follows: Amateur and Hack (each a �Tier�). Entrant�s Tier is determined by Sponsor in its sole discretion, which may be based in whole or in part on entrant�s performance and scoring in previous World Golf Tour game play on Sponsor�s website, if any. An entrant may only enter into one Tier of competition during the Contest Period. The entrants in each Tier will be given nine holes throughout the golf course, and are challenged to get the ball as close as possible to each of the nine holes, each in a single shot. To determine your score for each hole, Sponsor will combine the number of feet between where your ball lands and the location of the pin, plus any penalties. When entrant completes all nine designated holes, the combined score for all holes will comprise the entrant's final score. Entrants may play the Game only once during the Contest Period. The lowest scoring entrant in each Tier will be a potential winner.

    In the event of a tie, the better scoring entrant between or among the tied entrants will be the entrant with the lowest combined score for the final six (6) holes of the Game. If any ties remain, the better scoring entrant between or among the remaining tied entrants will be the entrant with the lowest combined score for the final three (3) holes for such Game. If any ties remain, the better scoring entrant between or among the remaining tied entrants will be the entrant with the lowest score for the 9th hole in such Game, and any remaining ties will be determined by identifying the lowest scoring entrant for each individual game hole, in sequence from 8th through to 1st, as is necessary to determine a winner.

  4. Prize.

    There are One Hundred Forty-Two (142) prizes to be awarded as follows:

    Hack Tier:

    One (1) First Prize: One WGT polo shirt (one to the lowest scoring entrant, approximate value (�ARV�) USD $50), and WGT credits* in an amount consistent with WGT credit allocation to first place scoring entry from a total 12,500 available WGT credits to be allocated among top seventy (70) lowest scoring Hack Tier entrants in accordance with the Payout Rules below; and

    Sixty-nine (69) Runner Up Prizes: WGT credits*. The sixty-nine lowest scoring entrants under the First Prize winner will each be awarded WGT credits in an amount consistent with WGT credit allocation from a total of 12,500 available credits in accordance with Payout Rules below.

    *A total of 12,500 WGT Credits will be awarded among the seventy lowest scoring entrants including First Prize winner, the division of the WGT Credits shall be governed by Payout Rules below (ARV: USD $125).

    Amateur Tier:

    One (1) First Prize: One WGT polo shirt (one to the lowest scoring entrant, ARV USD $50), and WGT credits* in an amount consistent with WGT credit allocation to first place scoring entry from a total 15,000 available WGT credits to be allocated among top seventy (70) lowest scoring Amateur Tier entrants in accordance with the Payout Rules below; and

    Sixty-nine (69) Runner Up Prizes: WGT credits*. The sixty-nine lowest scoring entrants under the First Prize winner will each be awarded WGT credits in an amount consistent with WGT credit allocation from a total of 15,000 available credits in accordance with Payout Rules below.

    * A total of 15,000 WGT Credits will be awarded among the seventy lowest scoring entrants including First Prize winner, the division of the WGT Credits shall be governed by Payout Rules below (ARV: USD $150).

    Payout Rules:

    Sponsor will use the Payout Rules below to allocate the designated number prize WGT credits available in each Tier among the top seventy (70) entrants in such Tier. The Payout Rules assign a specific percentage of the overall available purse to each of the top seventy entrants in each Tier. The payout percentages are as follows:

    If there are fewer than 70 entrants in a Tier, WGT credits will be allocated pursuant to the chart above based on each entrant�s place in the Contest. The WGT credits allocated for each position that doesn't have a winner in such place will be pooled and redistributed among the winners based on the actual percentage of WGT credits each winner was awarded in the first round of WGT credit allocation. All WGT credits offered as prizes will be awarded.

    Odds of winning depend on the number of eligible entrants in each Tier, their relative skill in the Contest, and the entrant�s Tier designation.

    Prizes are not transferable. No substitution of prizes for cash or for other goods and services is permitted, except Sponsor reserves the right to provide a substitute prize of approximately equal or greater value if the advertised prize becomes unavailable. Prize details including, if applicable, color, model, style, and size, at Sponsor�s sole discretion. WGT credit prizes subject to WGT Terms and Conditions [INSERT LINK TO TERMS AND CONDITIONS]. All taxes, including, without limitation, all federal, state, provincial, and local taxes, and international tariffs, are the sole responsibility of the winners.

    All prizes claimed in accordance with the Official Rules will be awarded. Winners may be required to provide a U.S., Canadian, United Kingdom, or German shipping address to claim prize. Prizes will be mailed within thirty (30) business days following Sponsor�s receipt of the completed Affidavit of Eligibility and, except where and as prohibited, a Liability Release and Publicity Release, as well as verification of winner�s eligibility. Allow four to six weeks for delivery of prize. WGT credits awarded as prizes will be deposited into winner�s World Golf Tour account within 30 days after the winner is selected and verified.

  5. Winner Selection and Notification.

    Winners will be determined and announced on or about the December 15, 2008 from all eligible entries received for the Contest. The judging will be conducted by Sponsor or its designee, the judge of the Contest, whose decisions are final and binding. Potential winners will be notified on or about December 15, 2008 by an email sent to the email address specified in the entry and posted on the World Golf Tour website. If potential winner cannot be contacted at this email, is contacted and does not respond as directed within seven (7) days of attempted notification, refuses the prize is ineligible to accept the prize or does not otherwise comply with these Official Rules, the prize may be forfeited and awarded to an alternate winner. Potential winner may be required to complete and sign an Affidavit of Eligibility and, except where and as prohibited, a Liability Release and a Publicity Release in the form provided by Sponsor, within seven (7) days of attempted notification in order to claim the prize. Potential winners may be required to show proof of identification within seven (7) days of attempted notification, or the prize may be forfeited and awarded to an alternate winner.
  6. General Terms.

    By entering the Contest, entrant accepts and agrees to abide by and be bound by the terms of these Official Rules, and assume sole liability and accept all risk of loss for injuries, including personal injuries and/or damage to property, caused or claimed to be caused by participating in this Contest or the acceptance, possession, shipping and handling, loss, use or misuse of, or travel to or from or in connection with the Contest or any prize awarded. Sponsor has the right to cancel, terminate or modify this Contest for any reason, including if it cannot be completed as planned due to computer virus, bugs, tampering, unauthorized intervention or technical failures and to select winner from eligible entries received on or before the termination date. Sponsor is not responsible for any failure to contact entrants, whether due to technical or human error.

    By entering this Contest, entrants grant to Sponsor a worldwide, perpetual, irrevocable, right and royalty-free license to use the entry, and, except where prohibited by law, entrant�s first and/or last name, city and state/province of residence, photo(s), voice and/or likeness; in any and all media but solely in connection with this Sweepstakes. By entering this Contest, entrants agree (a) that Sponsor has the right to exploit and utilize entrant�s first and/or last name, city and state/province of residence, photo(s), voice and/or likeness in any and all media but solely in connection with this Sweepstakes without any further attribution, notification or compensation to Entrant, except where prohibited; (b) to be bound by these Official Rules and the decisions of the judges; and (c) to be contacted by Sponsor or its agents by telephone, mail or email regarding this Contest.

    By entering the Contest, entrant releases and holds harmless Sponsor and its parent companies, subsidiaries, affiliates, and the directors, officers, employees or agents of each from any and all liability whatsoever for any claims, costs, injuries, losses or damages of any kind (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light) arising out of or in connection with the Contest, with the acceptance, possession, use, or misuse of any prize, or while traveling to or from any Contest or prize related activity.

    Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys' fees; and entrant hereby waives all rights to claim punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

    In the event that any provision of these Official Rules shall be unenforceable or invalid under any applicable law or be so held by applicable court decision, such unenforceability or invalidity shall not render these Official Rules unenforceable or invalid as a whole, and, in such event, such provision shall be changed and interpreted so as to best accomplish the objectives of such unenforceable or invalid provision within the limits of applicable law or applicable court decisions.

  7. Applicable Law.

    The Contest is governed by the laws of the state of California applicable to contracts entered into by California residents and to be performed within such State without regard to its conflict of law provisions, with venue in San Francisco County, California.
  8. Winners list.

    A list of Contest winners can be viewed on the "Recent Winners" webpage at www.wgt.com, and is also available by sending a stamped, and self-addressed envelope marked to "World Golf Tour Closet to the Pin Contest Winners, November, 2008,� 160 Sansome Street, 5th Floor, San Francisco, CA 94104. Requests must be received by December 30, 2008.
  9. Sponsor.

    This Contest is sponsored by World Golf Tour, Inc., 160 Sansome Street, 5th Floor, and San Francisco, CA 94104.

AFFIDAVIT OF ELIGIBILITY/RELEASE OF PUBLICITY AND LIABILITY

I represent and certify to World Golf Tour, Inc. (�Sponsor�), that I was 18 years of age or older as of the date of entry (or if the age of majority in my state or province/territory is greater than 18 years of age, I was at least the age of majority in my state or province/territory of residence as of the date of entry) and I am a legal resident of resident of one of the fifty United States, the District of Columbia, Canada (excluding Quebec), the United Kingdom, or Germany. I hereby certify that I am eligible, under the �WGT Monthly Closest to the Pin Tournament� (the �Contest�) official rules attached as Attachment A hereto (the �Rules�), to claim the applicable prize set forth below and further described in the Rules (the �Prize�). I represent that I have read, fully understand, have complied with, and agree to be bound by the Rules.

I grant Sponsor a worldwide, perpetual, irrevocable, right and royalty-free license to use my entry and, except where prohibited by law, my first and/or last name, city and state/province of residence, photo(s), voice and/or likeness; in any and all media solely in connection with this Contest.

I release and hold harmless Sponsor and its parent companies, subsidiaries, affiliates, and the directors, officers, employees or agents of each, from any and all liability whatsoever for any claims, costs, injuries, losses or damages of any kind (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light) arising out of or in connection with the Contest, with the acceptance, possession, use, or misuse of any prize, or arising out of or in connection with any travel to or from any Contest or prize related activity.

In the event that any provision of this Affidavit Of Eligibility/Release Of Publicity And Liability shall be unenforceable or invalid under any applicable law or be so held by applicable court decision, such unenforceability or invalidity shall not render this Affidavit Of Eligibility/Release Of Publicity And Liability unenforceable or invalid as a whole, and, in such event, such provision shall be changed and interpreted so as to best accomplish the objectives of such unenforceable or invalid provision within the limits of applicable law or applicable court decisions.

This Affidavit Of Eligibility/Release Of Publicity And Liability is governed by the laws of the California applicable to contracts entered into by California residents and to be performed within such State without regard to its conflict of law provisions with venue in San Francisco, California.
